Terms of Service

Welcome to Pro Guitar Tuner

This Terms of Service Agreement constitutes a legally binding contract between Pro Guitar Sweden AB (operating as “Pro Guitar Tuner” and “ProGuitar”) and you regarding use of the Pro Guitar Tuner website and associated products and services (the “Service”).

The term “use” encompasses any access, attempted access, or information exchange with the Service. These terms, combined with linked policies and the Privacy Policy, form the entire agreement between parties, superseding prior understandings.

Pro Guitar Sweden AB reserves the right to:

  • Modify terms and conditions consistent with law
  • Change or discontinue services or features
  • Deny or terminate user access

Changes become effective immediately upon posting notice. Continued use constitutes acceptance. Users should review terms periodically.

Eligibility

Users must be of legal age of majority in their jurisdiction. Minimum age requirement: 13 years old.

Your Permitted Use of Services and Content

The Service and Content (text, files, images, photos, video, sounds, musical works, applications, etc.) are provided for personal use only — not for commercial purposes or resale (except as expressly permitted).

Prohibited actions include:

  • Copying, reproducing, displaying, republishing, downloading, posting, digitizing, translating, modifying, transmitting, distributing, or commercially exploiting materials
  • Data mining, robots, or similar extraction tools
  • Authorizing third-party reproduction or modification of Content
  • Allowing unauthorized use without taking preventive steps

Security violations prohibited — users may not:

  • Access unauthorized data or accounts
  • Probe, scan, or test system vulnerabilities
  • Interfere with or disrupt service to users or networks
  • Submit viruses, worms, or Trojan horses
  • Send unsolicited emails or promotions

Violations may result in civil or criminal liability. Pro Guitar Sweden AB may investigate and cooperate with law enforcement.

The Service may contain links to external websites (“Third-Party Sites”). Pro Guitar Sweden AB does not control linked sites or their content, disclaims all liability for third-party use, and makes no endorsement or approval of linked sites.

Ownership

Pro Guitar Sweden AB owns and operates the Service. Content and Services (including intellectual property) remain the property of Pro Guitar Sweden AB and its licensors, protected by international copyright and trademark laws.

Except as permitted in this Agreement, users may not copy, reproduce, modify, adapt, translate, republish, upload, transmit, distribute, sublicense, sell, reverse engineer, decompile, or disassemble Service parts without prior written permission.

Disclaimers and Limitations of Liability

Pro Guitar Sweden AB, its subsidiaries, affiliates, related companies, suppliers, licensors, partners, and their officers, directors, employees, and agents provide the Service on an “AS IS” and “AS AVAILABLE” basis without any warranty.

Pro Guitar Sweden AB expressly disclaims all warranties and conditions including merchantability, title, accuracy and completeness, uninterrupted or error-free service, fitness for particular purpose, and non-infringement.

Pro Guitar Sweden AB will not be liable for indirect, incidental, consequential, special, or exemplary damages, lost profits, business interruption, reputational harm, or data loss — even if advised of possibility — arising from Service use or inability to use.

Indemnification

Users agree to fully indemnify, defend, and hold harmless Pro Guitar Sweden AB, its licensors, suppliers, agents, successors, assigns, and their directors, officers, employees, and consultants from all claims, damages, losses, costs (including attorney fees), and expenses arising from user Agreement breach, intellectual property infringement allegations, Service-related activities, or user negligent or willful misconduct.

Controlling Law and Jurisdiction

This Agreement is interpreted per Swedish law without regard to conflict-of-law provisions. Parties submit to personal jurisdiction of Stockholm, Sweden courts.

Dispute Resolution

Users and Pro Guitar Sweden AB agree all disputes, claims, or controversies arising from this Agreement or Service use will be settled by binding arbitration, except each party retains rights to seek injunctive or equitable relief in competent court for intellectual property infringement prevention.

Users waive jury trial rights and class action participation rights.

Term and Termination

This Agreement is effective from first Service access and remains effective until terminated. Users may terminate by ceasing Service use. Pro Guitar Sweden AB reserves the right to modify, discontinue, or temporarily suspend the Service, with or without notice.

Miscellaneous

If any Agreement provision is unlawful, void, or unenforceable, that provision is severable and does not affect remaining provisions. This is the entire Agreement regarding the subject matter, superseding all prior agreements.
